Terms and Conditions

1. Acceptance of Terms

By using our website to place an order, you agree to these Terms and Conditions, as well as to the laws and regulations of the State of Kuwait, including the Kuwait Consumer Protection Law (Law No. 39 of 2014).

2. Platform Role & Third-Party Sellers

This platform acts as a commission-based ordering service that connects you with vendors in Kuwait’s fish market. We do not own, handle, or process the seafood ourselves, but we coordinate your order, collection, packaging, and delivery on behalf of the vendor.

All products are sold directly by third-party sellers, and the platform acts as a trusted intermediary.

3. Market Availability & Daily Prices

  • Seafood pricing and availability are determined by the fish market on a daily basis.
  • We cannot guarantee the availability of specific species or weights until confirmed after order submission.
  • Orders placed after the daily cut-off time may be fulfilled the following day.

4. Order Confirmation

After you place an order, we will confirm product availability with the fish vendor. You will receive a confirmation message once the order is locked. Changes cannot be made after confirmation.

5. Delivery

  • Deliveries are coordinated by our logistics team and delivered in chilled packaging.
  • Customers must be available to receive the order on the agreed delivery day and time.
  • We are not responsible for product quality if no one is available to receive the order.

6. Payment

Prices are displayed in Kuwaiti Dinar (KWD). Payment is required before or at delivery depending on the selected payment method. We accept KNET, Visa/Mastercard, and COD where available.

7. Perishable Nature & Complaints

Fresh seafood is highly perishable. Once delivered, it must be immediately refrigerated. We are not liable for deterioration due to delay in storage by the customer.

If a product is incorrect, visibly damaged, or spoiled at the time of delivery, please report it within 1 hour of receiving it, along with clear photos, to be eligible for refund or replacement.

8. Limitations of Liability

As we do not own the seafood, we are not liable for vendor-related issues beyond the logistics and service we provide. We will, however, mediate all legitimate complaints on your behalf and coordinate with the seller for resolution.

9. Intellectual Property

All branding, product descriptions, logos, and site content are the intellectual property of FishMarketKw and may not be reused without permission.

10. Product Inspection Upon Delivery

 

Customers are required to inspect all seafood products immediately upon delivery and in the presence of the delivery personnel. Acceptance of the order at the time of delivery is considered confirmation that the items were received in satisfactory condition. If you wish to reject any item due to visible damage, incorrect product, or quality concerns, this must be communicated before the delivery driver leaves. Once the delivery is accepted, the order will be deemed final, and returns or complaints regarding quality will not be accepted unless reported during that inspection window.

11. Governing Law

These Terms are governed by the laws of the State of Kuwait. Disputes will be settled through Kuwaiti courts.
